1. The Service

The Service allows users to upload photos and use artificial intelligence to generate modified or humorous images ("Generated Images"). The Service is provided for entertainment and creative purposes only.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.

3. User Content

3.1 Uploaded Content

You may upload photos or images ("User Content") to the Service.

By uploading User Content, you represent and warrant that:

• You own the content or have obtained all necessary rights, permissions, and consents to upload and use it
• Any identifiable individuals in the content have consented to its use where required by law
• The content does not violate any law or infringe any third-party rights

You are solely responsible for your User Content.

3.2 Prohibited Content & Use

You agree not to upload, generate, or use the Service for content that:

• Is illegal, abusive, harassing, defamatory, or threatening
• Violates privacy, publicity, or likeness rights
• Involves sexual content with minors
• Is intended to impersonate, deceive, or mislead others
• Is used for political persuasion involving real people without consent
• Is hateful, discriminatory, or promotes violence

We reserve the right to remove content or restrict access at our discretion.

4. AI Processing & Data Use

4.1 Processing of Content

To provide the Service, we process uploaded photos and generate images using AI systems.

We do not:

• Sell user photos or generated images
• License user content to third parties for advertising
• Use user photos or generated images to train AI models

4.2 Limited Retention

We may temporarily retain uploaded content and generated images solely for:

• Operating the Service
• Quality control and performance monitoring
• Safety, abuse prevention, and debugging

Content is never retained for training or resale.

5. Ownership & Rights

5.1 Your Ownership

• You retain ownership of your uploaded photos
• You own the Generated Images created using the Service

5.2 License to Us

You grant us a limited, non-exclusive, non-transferable license to host, process, and display your content only as necessary to provide and improve the Service.

This license ends when your content is deleted, except where retention is required for legal or operational reasons.

6. Copyright & DMCA Policy

AI4IP LLC respects intellectual property rights and complies with the Digital Millennium Copyright Act ("DMCA").

If you believe content on the Service infringes your copyright, please send a notice to:

Your notice should include:

• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and its location
• Your contact information
• A statement that you have a good-faith belief the use is unauthorized
• A statement, under penalty of perjury, that the information is accurate
• Your physical or electronic signature

We may remove or disable access to content alleged to be infringing and may terminate repeat infringers.

7. Disclaimers

The Service and all Generated Images are provided "as is" and "as available."

We make no guarantees regarding accuracy, reliability, or suitability of AI-generated content. Outputs may be unpredictable.

8. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the greater of $100 or the amount you paid us (if any) in the past 12 months

9. Termination

We may suspend or terminate access to the Service at any time for violations of these Terms or misuse of the Service.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
